Turns out being automatically tagged in a photo could result in a lawsuit. 

According to NBC Chicago, Facebook users in Illinois can sue Facebook for their use of biometric tagging.

Bio-what? Biometric tagging refers to collecting biometric data about a person, meaning your face, and then using it to identify you, according to American Preppers Online.

Think about the last time you uploaded a photo to Facebook. Immediately Facebook asked you to tag yourself, your best friend, your mom, even your best friend's mom in the photo because Facebook already knew who it was.

According to Illinois' Biometric Information Privacy Act, this is a no-no.

Three men from Illinois brought the issue to Illinois courts initially, then the suit was transferred to California, as reported by NBC. The California judge decided that Facebook is in fact violating the Illinois BIPA. 

What does think mean for those of us being "tagged" on Facebook? Potentially a lot! We'll have to follow this story for more info.
